ORDER

This criminal petition is filed under Section 482 Cr.P.C., to quash the proceedings in C.C.No.225 of 2016 on the file of Judicial First Class Magistrate, Razole, East Godavari District. Learned counsel for petitioner, Sri Polisetti Radha Krishbna, is not pressing the relief. However, in the grounds, it is mentioned that the petitioner filed a petition under Section 70(2) Cr.P.C., to recall NBW, but the trial Court has not entertained the said petition. Therefore, unless the petitioner appears in person before the Court, by exercising power under Section 482 Cr.P.C., this Court can issue necessary direction to the Courts subordinate to it within the State which are under the control of this Court.

In view of the peculiar facts and circumstances of the case, the Judicial First Class Magistrate, Razole, East Godavari District, is directed to entertain the petition and pass appropriate orders in accordance with law.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
