THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37279 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 2nd respondent in not taking any action against respondents 3 & 4 even though FIR No.156 of 2016, dated 19.09.2016, is registered. Heard and perused the material available on record. The case of the petitioner is that the petitioner is the owner of agricultural land at Keshavapatnam Village, Shankarapatnam Mandal, Karimnagar District and that earlier, there were some disputes with regard to the boundaries of the petitioner's land with respondents 3 and

4. The grievance of the petitioner is that respondents 3 and 4 illegally trespassed into part of the petitioner's land and removed the boundary stones on 15.06.2016. The petitioner went to the 2nd respondent to inform the same. On instructions of the Superintendent of Police, the 2nd respondent registered the said complaint on 19.09.2016 as FIR No.156 of 2016 for the offences punishable under Sections 447, 427 read with 34 IPC against respondents 3 and 4, but till now no action is taken against respondents 3 and 4 by the 2nd respondent.

Learned counsel for the petitioner informed that the 2nd respondent not only failed to investigate into the crime, but also threatening the petitioner to dispossess him from his agricultural lands. Considering the grievance of the petitioner and the submissions of the learned counsel for the petitioner, the 2nd respondent is directed not to interfere in the affairs of the petitioner, more particularly, the disputes between the petitioner and respondents 3 and 4, and further directed to complete the investigation in FIR No.156 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, within a period of six (6) months.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 1st November, 2016 KL
