The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.10753 of 2017 Order:

This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioners/accused Nos.1 & 2, seeking anticipatory bail in the event of their arrest in connection with Crime No.386 of 2017, on the file of Railway Kodur Police Station, Railway Kodur, YSR Kadapa District, registered for the offences punishable under Sections 307, 324, 354 r/w 34 IPC and Section 3(i)(r)(s) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) (amended) Act, 2015.

Heard the learned Counsel for the petitioners, learned Additional Public Prosecutor appearing for the respondent- State and perused the record.

As per report lodged by the defacto-complainant on 03.10.2017 at 9.30 p.m., the petitioners went to the scene of offence. Petitioner/accused No.1 beat the defacto-complainant with an iron rod. When another person came to rescue the defacto-complainant, petitioner/accused No.2 caught hold of him and petitioner/accused No.1 beat him. When the son and other relatives of the defacto-complainant came to the scene of offence, the petitioners escaped in a car.

Dr.SA, J Crl.P.No.10753 of 2017 Dt: 14-11-2017 Having regard to the specific overt acts and the serious allegations levelled against the petitioners and in view of the gravity of offences, it is not a fit case to grant anticipatory bail to them.

Hence, the Criminal Petition is dismissed.
