THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.41630 of 2018 ORDER:

It is stated by the learned counsel for the petitioner that in similar circumstances this Court allowed W.P.No.29829 of 2018, dated 23-08-2018 and same is not disputed by learned Assistant Government Pleader for Revenue appearing for respondents.

In view of the same and for the reasons alike in the order dated 23-08-2018, this Writ Petition is also allowed setting aside the draft Memo No.G2/19134/2011, dated 01.12.2011 issued by the 2nd respondent. There shall be a consequential direction to the 4th respondent to receive and process the document presented by the petitioner in respect of the subject property without reference to the order dated 15.03.2011 of the High Court of Madras in Contempt Petition No.1205 of 2010. In the event, the document presented is found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, 4th respondent shall complete the registration formalities and release the document in accordance with due procedure. If he is not intending to register the same, he shall record reasons and communicate the same to the party. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
