Ch.Srinivasulu Petitioner (Accused No.3 in Cr.No.139/2017 of Nandyal II Town P.S., Kurnool Dist) AND The State of Andhra Pradesh, Station House Officer, Nandyal II Town Police Station, Nandyal, Kurnool District, rep. by Public Prosecutor, High Court, Hyderabad. Respondent Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to release the petitioner on bail in the event of his arrest in FIR.No. 139/2017 dt. 09-08-2017 on the file of the Station House Officer, Nandyal II Town Police Station, Nandyal, Kurnool District, Andhra Pradesh.

The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of M/s. Rachna S.Waddepalli, Advocate for the Petitioner and of the Addl. Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:

" This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioner/accused No.3, seeking anticipatory bail in the event of his arrest in connection with Crime No.139 of 2017, on the file of the Station House Officer, Nandyal II Town Police Station, Nandyal, Kurnool District, registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondent- State and perused the record. As per the report lodged by the defacto-complainant with the Police on 0908-2017, the petitioner is her husband; he brought her to India in the year 2015; he left her and went away without informing her; and that he used to harass her to do some job.

At the hearing, it is brought to the notice of the Court that the other accused were arrested by the Sub-Inspector of Police concerned and set free under the provisions of the Code of Criminal Procedure. Having regard to the nature of accusation, the petitioner can be granted anticipatory bail.

Accordingly, the petitioner/accused No.3 is directed to surrender before the Station House Officer, Nandyal II Town Police Station, Nandyal, Kurnool District, within one month from the date of this order and on such surrender, the said Station House Officer shall release him on bail, on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, the petitioner/accused No.5 shall co-operate with the Investigation Officers.
