THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.37769 OF 2016 ORDER:

This Writ Petition is filed for the following relief: ".. to adjudicate upon the writ petition, as prayed for, hereunder:

a) to issue a Writ, Order or direction, more particularly, the one, in the nature of Writ of Mandamus, declaring the action of the respondent in demolishing the wall without following due process of law, causing financial loss to the petitioner and causing disturbance and nuisance to smooth running of college, as illegal, against the provisions of Municipalities Act, in violation of Articles 14, 19 and 21 of the Constitution of India.

b) consequently to direct the 2nd respondent to pay compensation for demolishing the compound wall in total violation of the principles of natural justice, and, not to allot the subject land to any third parties for proposed cycle stand, or, any other purpose, which would cause disturbance, and nuisance for smooth functioning of college, and c) to pass such other order, or orders, as the Honourable High Court may deem fit and proper, in the interests of justice."

Learned counsel for the petitioner states that after filing of this Writ Petition, a representation is submitted by the petitioner before the District Collector, Guntur District, for allocation of the land, which is to be utilised for parking of the bicycles. In view of the same, the Writ Petition is dismissed leaving it open to the petitioner to pursue the representation stated to have been filed by the petitioner. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
