This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, seeking grant of bail to the petitioner, who is the accused, in Cr.No.615 of 2018 on the file of the Station House Officer, Neredmet Police Station, Rachakonda District. The offences alleged are under Section 354(A) of the Indian Penal Code and Section 11(iv) read with Section 12 of the POCSO Act.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that investigation is almost complete and Section 164 Cr.P.C statement of the victim is also recorded.

The learned Public Prosecutor, on the other hand, submits that the investigation is not yet completed.

However, considering the facts of the case and the allegation that petition misbehaved with a girl aged 14 years, this Court opines that this is not a fit case for grant of bail to the petitioner. Hence, the criminal petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed. __________ T. RAJANI, J November 26, 2018 DSK
