THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.21771 of 2016 ORDER :

The case of the petitioner is that he is the absolute owner and possessor of the land in an extent of Ac.0.10 cents in Door No.10-94, situated in Amaravathi Village and Mandal, Guntur District, having obtained same from his father by way of a registered Settlement Deed No.1613/1979, dated 31.12.1979, to an extent of Ac.0.05 cents executed in his favour; and by way of a registered Agreement of Sale vide document No.1734/1994, for the remaining extent executed in favour of his children. While so, he was issued a notice dated 27.06.2016 under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905 seeking to evict him from the subject premises. Though the petitioner submitted a detailed explanation on 01.07.2016, as the 4th respondent refused to acknowledge receipt of the same, the petitioner uploaded the said explanation through Meekosam Web Site. Inspite of the same, without passing any orders on the same, the respondents are trying to evict him from the subject premises. Hence the present writ petition.

2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

3. In view of the facts and circumstances of the case, it is open for the petitioner to submit a fresh explanation to the 4th

respondent within a period of two weeks from today and on receipt of such explanation from the petitioner, the 4th respondent shall consider the same and pass appropriate orders, after giving an opportunity of hearing to the petitioner. Till orders are passed by the 4th respondent and communicated the same to the petitioner, the petitioner shall not be evicted from the subject premises for a period of four weeks thereafter, to enable him to pursue appropriate remedies available under law.

4. Subject to the above direction, this writ petition is disposed of, at the admission stage. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs. _________________________ A. RAJASHEKER REDDY, J 08.07.2016.
