Having argued for some time, the learned counsel for the petitioners/ accused Nos.1 and 3 sought permission to withdraw this Criminal Petition, since it is not a fit case to allow the application under Section 438 of Cr.P.C.

Accordingly, this Criminal Petition is dismissed as withdrawn. It is made clear that the petitioners/ accused Nos.1 and 3 are not entitled to file another application before this Court on similar averments.
