THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.41713 OF 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "to issue an appropriate writ order or direction more particularly in the nature of Writ of Mandamus declaring the inaction of the respondents in taking steps to reach the fish boats at new canal of Chinagollapalem Village without any interruption on the representation dated 29-10-2018 of the petitioner is arbitrary, illegal, capricious and violative of fundamental rights guaranteed under Article 19(1)(g) of the Constitution of India and consequently direct the respondents to consider the representation dated 29-10-2018." 2.

I have heard the submissions of the learned counsel for the petitioner and of the learned Government Pleader for Fisheries (AP) appearing for the respondents 1, 3 and 4. I have perused the material record.

The only request of the petitioner is to consider and dispose of the representation, dated 29.10.2018, submitted by the petitioner to the Joint Director of Fisheries, Machilipatnam, Krishna District/3rd respondent. However, learned Government Pleader, on written instructions, dated 19.11.2018, a copy of which is placed on record, would submit that no such representation is received by the 3rd respondent.

Having regard to the submissions, the Writ Petition is disposed of reserving liberty to the petitioner to submit a fresh representation along with a copy of the representation, dated 29.10.2018, to the 3rd respondent within a week from the date of

receipt of a copy of this order. On such representation being submitted by the petitioner, the 3rd respondent shall consider and dispose of the same, within two (2) weeks from the date of receipt of the representation, however, in strict accord with the procedure established by law; and communicate the decision taken thereon to the petitioner within a week thereafter.

There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
