Having heard the submissions the learned counsel for the petitioners and learned public prosecutor, representing the 1st respondent - State, before ordering notice to the 2nd respondent - defacto complainant, there is no grounds to transfer the case, but for liberty given to the petitioners to apply before the Magistrate either under Section 126 Cr.P.C. or Section 205 Cr.P.C., as the case may be, to dispense with the personal appearance, permitting appearance through advocate or if at all under Rule 37 of the Criminal Rules of Practice for consideration after hearing with necessary conditions of personal appearance as and when required. 2.
According and with the above observation, this transfer criminal petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
