THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11023 of 2017 ORDER:
Heard learned counsel for the petitioners/A.2 and A.3, learned Additional Public Prosecutor for the respondent State, and perused the record.
This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioners/A.2 and A.3 in Crime No.142 of 2017 of Mangalagiri Town Police Station, Guntur District, for the offences punishable under Sections 498-A and 306 IPC. Learned counsel for the petitioners/A.2 and A.3 would submit that the petitioners/A.2 and A.3 are innocent persons and falsely implicated in this case and ultimately, prayed to grant bail to the petitioners/A.2 and A.3 under Section 438 Cr.P.C. It is brought to the notice of this Court by the learned Additional Public Prosecutor that earlier bail petition, Crl.P.No.6284 of 2017, was dismissed by this Court vide order, dated 24.08.2017. It is also brought to the notice of this Court that there is also dying declaration attributing allegations against these petitioners also.
There are no changed circumstances. The gravity of offence is high. Therefore, it is not a fit case to grant bail to the petitioners/A.2 and A.3 under Section 438 Cr.P.C. In the result, the Criminal Petition is dismissed. ___________________________ Dr. SHAMEEM AKTHER, J 20th NOVEMBER, 2017.
