HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 41681 OF 2018 O R D E R :
This writ petition is filed challenging the action of the respondent Nos.1 to 4 in refusing to release the electricity supply of 27 meters domestic category of total 60,000 watts to the premises of the petitioners bearing No.23-1-432/4 and 23-1-432/5, situated at Kotla Alijah, Hussaini Kothi, Yakutpura, Hyderabad, by insisting upon the petitioner to furnish building permission as a pre condition for release of electricity service connection. Heard learned counsel for the petitioners who submits that the lis in the writ petition is squarely covered by the order dt.15.09.2017 passed by this Court in Writ Petition No.31270 of 2017.
The same is not disputed by Sri R.Vinod Reddy, learned Standing Counsel appearing for respondents 1 to 4 and Sri Sampath Prabhakar Reddy, learned Standing Counsel for the 5th respondent. In view of the same and for the reasons alike, this writ petition is also disposed of directing the respondents to release the power supply to the premises of the petitioners subject to the compliance of the terms and conditions of supply and on furnishing an undertaking to produce the occupancy certificate from the
concerned Municipality/Municipal Corporation, within a period of six months, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
