HON'BLE SRI JUSTICE S.V. BHATT W.P. No.12279 OF 2016 ORDER:

The petitioner prays for a direction not to disturb the petitioner's possession in an extent of Ac.1-00, Ac .0.27 cents, Ac .0.70 c ents, Ac .0.40 cents and Ac.0.61 cents in Survey Nos.113, 113/ 7, 113/ 14, 113/ 11 and 113/ 51 respectively of Chinamushidiwada Village, Pendurthy Mandal, Visakhapatnam District without recourse to law.

The learned Assistant Government Pleader (Assignment) on instructions submits that it has come to the notice of 4th respondent that the assignment conditions are breached and action is warranted under Act 9/ 1977. The 4th respondent would follow the procedure prescribed by law and till such time, will not interfere with the possession or enjoyment of the petitioner. The statement made basing on the written instructions is placed on record and the writ petition is disposed of accordingly. No order as to costs.
