ORAL ORDER:

Heard learned counsel for petitioner and learned standing counsel for respondent corporation and with their consent the writ petition is taken up for disposal.

According to petitioner, he entered into an agreement on 27.6.2015 with respondent corporation to operate bus bearing No. TS 08 UB 2809 on route Kandukur to Ibrahimpatnam. The agreed distance was 322 KMs, however, according to learned counsel for petitioner the actual operational distance has exceeded by 11 KMs. Though, the distance originally agreed upon was only 322 KMs and no charges are paid for additional 11 KMs, which is exceeding the limit agreed upon, having expressed his objection for such excess utilization of distance and not responding to the requests made by petitioner on several occasions to various authorities, this writ petition is filed. 3.

When the matter is taken up, learned counsel for petitioner as well as learned standing counsel for respondent corporation agreed for disposal of the writ petition with a direction to the Depot Manager, Ibrahimpatnam/4th respondent to examine the claim of the petitioner as ventilated in his representation dated 31.7.2018. Having regard to the same, the writ petition is disposed of directing the 4th respondent to consider the representation of the petitioner dated 31.7.2018 with reference to payment of hire charges for additional Kilometers covered by the vehicle of the petitioner in terms of agreement dated 27.6.2015 and pass appropriate orders as warranted by law within a period of six weeks from the date of receipt of copy of this order. No costs. Miscellaneous petitions, if any pending, are closed.
