Dharmaraj Singh Petitioner (Accused No.3 in Cr.No.34/2016 of Maredumilli P.S., E.G.Dist) AND The State of Andhra Pradesh, through Station House Officer, Maredumlli Police Station, East Godavari District, Andhra Pradesh, rep. by P.P., High Court at Hyderabad. Respondent Petition under Section 437 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to grant regular bail to the Petitioner and enlarge the petitioner on bail in Crime No. 34 of 2016 of Maredumilli Police Station, East Godavari District, Andhra Pradesh. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Milind G Gokhale, Advocate for the Petitioner and of the Addl. Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:
" Heard learned counsel for the petitioner/A.3 and learned Additional Public Prosecutor for the respondent State, and perused the record. This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.3 in Crime No. 34 of 2016 of Maredumilli Police Station, East Godavari District, for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of NDPS Act.
It is brought to the notice of this Court that A.1 and A.2 were granted bail as per the orders passed by this Court in Crl.P.No.13094 of 2016 on 12.09.2016. It is alleged that pursuant to the confession made by A.1 and A.2, the petitioner/A.3 is made as accused in this case. The petitioner/A.3 was remanded to judicial custody on 10.08.2017. Under these circumstances, the petitioner/A.3 can be enlarged on bail on some conditions.
In the result, the petitioner/A.3 is ordered to be released on bail on his executing a personal bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned I-Additional District and Sessions Judge, Rajamahendravaram. On such release, the petitioner/A.3 shall attend before the Station House Officer, Maredumilli Police Station, on every Sunday between 9.00 and 10.00 a.m. till filing charge sheet.
