HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.26258 of 2016 ORDER:

This writ petition is filed seeking a writ of Mandamus challenging the impugned proceedings of the second respondent vide order No.A3/4693/2009 dated 02.01.2010 as null and void.

2. Heard the learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Rural Development (Telangana) and Sri G.Narender Reddy, learned standing counsel for the third respondent.

3. It is the case of the petitioner that she purchased an extent of 822.66 sq. yards in Survey No.9/53 of Gattu Village and Mandal, Mahabubnagar District, under a registered sale deed dated 20.07.2009. The petitioner submitted an application to the third respondent seeking permission for construction of the house. The third respondent issued proceedings on 08.09.2009 permitting the petitioner to make constructions as per sanctioned plan. While so, on 02.01.2010, the second respondent issued the impugned proceedings without giving any notice to the petitioner.

4. At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated 04.07.2016.

5. In view of the submissions made by both counsel, this Court is not inclined to go into the merits of the main case.

6. Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the

representation of the petitioner dated 04.07.2016, after affording a reasonable opportunity to the petitioner, in accordance with law as expeditiously as possible, preferably, within a period of three (3) months from the date of receipt of copy of this order.

7. Accordingly, this writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
