HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.41718 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 2 to 4, in not releasing/paying the amounts totaling to Rs.25,71,300/- for the works executed by the petitioner i.e lifting of garbage during the period of 11.5.2016 to 9.6.2016 by utilizing six ten Tonner and two JCBs vehicles, even after submitting the utilization certificate by the 5th respondent and submitting the bills on 30.8.2018 along with the representations dated 24.7.2018 and 13.11.2018, as illegal and arbitrary.

Though various grounds are raised, the learned counsel for the petitioner submits that though the petitioner executed the above said works and the 5th respondent submitted the utilization certification, the respondents 2 to 4, are not taking any steps to pay the amounts, to which the petitioner is entitled. The petitioner has also submitted the representation dated 13.11.2018 along with the bills, requesting the respondents 2 to 4 to clear the bills, but the respondents 2 to 4 did not take any steps so far. Hence, the present writ petition. The learned Government Pleader for Municipal Administration, would submit that the respondents 2 to 4 may be directed to deal with the representation dated 13.11.2018, submitted by the petitioner and pass appropriate orders, in accordance with law.

Having regard to the above, the present writ petition is disposed of directing the respondents 2 to 4, to deal with the representation dated 13.11.

giving the reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
