THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.29801 OF 2016 O R D E R :

This writ petition is filed aggrieved by the action of the 2nd respondent in not declaring the Adi-Andhrapalli Chakirevu Cheruvu as Schedule Caste (Madiga Community) tank, as illegal and arbitrary.

Learned counsel for the petitioner has not brought to my notice as to what is the violation committed by the respondents except reiterating the contents of the affidavit. Learned Standing counsel for the 5th respondent submits that the subject tank is a public tank and all the public have access to the same and the petitioner cannot file the present writ petition seeking to declare the subject tank as petitioner's community tank. A reading of the aforesaid prayer does not show that what right of the petitioner's is violated and it is not known under which provisions of law, the petitioner seeks prayer in the writ petition. In view of the same, there is no basis for grant of mandamus as claimed by the petitioner. Therefore, I do not see any merit to entertain the writ petition.

Accordingly, the writ petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 02.09.2016 dv
