THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2327 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 to 3 seeking to quash the proceedings against them in C.C.No.469 of 2015 on the file of the Judicial Magistrate of First Class, Ramannapet, Nalgonda District.

Heard and perused the material available on record. It is alleged that the 1st petitioner prepared forged documents and used the same as genuine and got registered the land of an extent of Acs.6.03 gts., situated in different survey numbers in Velvety Village, in favour of the 2nd petitioner. After arguing for some time, the learned Counsel for the petitioners submitted that the petitioners may be permitted to file discharge application and their presence before the trial Court may be dispensed with.

Considering the facts and circumstances of the case and the submission made by the learned Counsel for the petitioners, the petitioners are permitted to file discharge application before the trial Court and on such application being filed, the trial Court shall consider the same in accordance with law. Till disposal of such discharge application, the presence of the petitioners before the trial Court is dispensed with. In case, the petitioners are aggrieved over the order, if any, passed by the trial Court in the discharge application, they can approach the appropriate forum for appropriate relief.

Accordingly, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
