THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11113 OF 2017 ORDER:

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 438 Cr.P.C. for grant of bail to the petitioner/accused in Crime No.167 of 2017 of Tiruchanoor Police Station, Chittoor District for the offence punishable under Section 306 IPC.

The material on record reveals that the petitioner was in love with the deceased. Thereafter, he did not marry her. On the date of incident, he has taken her cell phone. Due to his harassment, the deceased having vexed with her life, took poison and committed suicide. The allegations are grave. The matter requires investigation. If the petitioner is released on bail, there is possibility of winning over the witnesses and causing disappearance of material evidence. Therefore, it is not appropriate to enlarge the petitioner on bail under Section 438 Cr.P.C.
