THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11082 OF 2017 ORDER:

Heard learned counsel for the petitioner/A.9, learned Additional Public Prosecutor for the respondent State and perused the record.

This petition is filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner/A.9 in Crime No.172 of 2015 of Ponnur Rural Police Station, Guntur District for the offences punishable under Sections 366, 323, 342 and 509 read with Section 34 IPC.

Learned counsel for the petitioner would submit that Section 366 IPC has no application to the case on hand. Learned Additional Public Prosecutor opposed the grant of bail to the petitioner.

The earlier bail application of the petitioner was dismissed by this Court vide order dated 13.04.2017 in Crl.P.No.709 of 2017. In the said criminal petition, elaborate order was passed declining the bail under Section 438 Cr.P.C. Filing charge sheet is not a changed circumstance.
