HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.8408 OF 2016 ORDER: (Per the Hon'ble Sri Justice S.V.Bhatt) The petitioner prays for the following relief: ".....this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the E-Auction Sale Notice dated 08.02.2016, issued by the respondent herein and further proceeding for auction on 14.03.2016 in respect of subject properties as notified in item No.1 i.e., in respect of Fixed Assets of the Company including EM on land and building for an extent of 14618 Sq.yards and Ac.18.92 cents located at D.No.4-131-1-6 under S.Nos.93/1, 93/2, 94/1, 94/2, 103/1, 103/2 located on Vijayawada-Hyd highway road, Keesara, Kancharcharla Mandal, Krishna District, and item No.2 i.e.

, land for an extent of 980.98 sq. yds with building constructed thereon (stilt+4 floors) located at D.No.13-26-26, Opp: BSNL building, Chuttugunta, Eluru Road, Vijayawada, Krishna District belonging to M/s Agri Gold Farms Estates India Pvt. Ltd., of the said E-Auction sale notice dt.08.02.2016 contrary to the directions issued by the Hon'ble High Court in PIL No.193/2015 from time to time and also the attachment orders issued by the Government of Andhra Pradesh vide G.O.Ms.No.23, dated 20.02.2015, as illegal, arbitrary, unconstitutional, mala fide and contrary to the spirit of the orders of the Hon'ble High Court passed in PIL No.193/2015 and to consequently set aside the same and to pass...." The main challenge in this writ petition is against the auction scheduled to be held on 14.03.2016.

At the hearing, learned counsel appearing for parties submit that the auction scheduled on 14.03.2016 did not take place and the cause in the writ petition is rendered infructuous for the present.

The statement of learned counsel is placed on record, the writ petition is disposed of as infructuous. There shall be no order as to costs.
