THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T. AMARNATH GOUD WRI T PETI TI ON No.34586 of 2017 ORDER: (per Justice Sanjay Kumar) The petitioner seeks a writ of habeas corpus to produce three persons, namely Pattan Kamurinnisa, Pattan Mastan Khan and Pattan Hassan Khan, before this Court and set them free on the ground that they were held in illegal custody by the Guduru police. Counter-affidavit was filed by the Sub-Inspector of Police, Guduru Police Station, Krishna District, stating that the named three persons were arrested on 18.10.2017 by him at the RTC Bus Stand, Gudiwada, Krishna District, and that they were produced before the learned Special Mobile Judicial Magistrate of First Class, Machilipatnam, on the same day. Sri N. Tata Babu, learned counsel for the petitioner, states that in the light of the counter-affidavit averments, no cause survives in this writ petition.
Recording the said statement, the writ petition is dismissed leaving it open to the petitioner and the alleged detenus to avail appropriate remedies in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
