THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.39316 OF 2017 ORDER: (oral) (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner seeks direction thereby to direct the 3rd respondent to produce S.Mubarak @ Ali, S/o Shaik Mohammed hanif, before this Court and he may be ordered to be released forthwith after declaring his detention, as illegal and unconstitutional.

2. The respondents have filed counter-affidavit, whereby stated that, basing on Mahazarnama, they registered a case in Crime No.444 of 2017 under Section 147, 148, 379, 109, 120 (B), 307, 353 read with 149 IPC, Section 20(1) (c)(ii) (iii)(iv)(vi)(x) of A.P. Forest amendment act 2016 (A.P.Act No.15 of 2016), Section 20(d)(i)(a)(b), Section 29(2)(b)(4)(a)(i)(ii)(b) of A.P. Forest amendment act 2016 (A.P. Act No.15 of 2016) Rule 3 of A.P. Sandal Wood transit rules 1959 and Sec.3 of PDPP Act 1984 of Railway Koduru Police Station, YSR District, and the alleged detenu was arrested along with A-1, A-3 and A-4 and produced before the Judicial First Class Magistrate, Railway Koduru, on 21.11.2017, and thereafter, the said Magistrate remanded them to judicial custody and they were lodged at Central Prison, Koduru.

3. In view of the above, no further direction is required to be passed in the present petition.

4. Accordingly, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous petitions, if any pending, shall stand closed.
