THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.35458 of 2016 ORDER:

Petitioner prays for the following relief:

.... to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of respondent No.4 in issuing the impugned notice bearing No.09/2016, dated 03.09.2016 and consequential notice vide G.P.No.2 of 2016, dated 06.09.2016 is illegal, null, arbitrary, against principle of natural justice and void and contrary to Panchayat Raj Act and consequently, set aside the impugned notice bearing No.09/2016 dated 03.09.2016 and consequential notice vide G.P.No.2 of 2016, dated 06.09.2016 of respondent No.4....

The Standing Counsel, on instructions, submits that the Gram Panchayat is prepared to consider the representation in the background of the sanctioned lay out, the alignment of houses on the same road, take a decision and communicate to petitioner. The statement is placed on record and the writ petition is disposed of by this order:

"The Gram Panchayat, Lingampet-respondent No.4 shall not only take a decision on the representation of petitioner, but also afford opportunity to petitioner to explain the right and title claimed by him. Thereafter, the decision taken is communicated within four weeks from today. The petitioner, if finally aggrieved against such

decision, is given liberty to pursue the remedies available within the four corners of law."
