THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE P.KESHAVA RAO W.P.NO.34369 OF 2017 ORAL ORDER (Per SKK,J) This writ petition is filed for a writ of Habeas Corpus directing the respondents to produce the petitioner's husband by name Kommineni Kishore before the court.

The Sub Inspector of Police, Machavaram Police Station, Vijayawada City, Krishna District, filed counter affidavit on behalf of 4th respondent. In the counter affidavit it is stated inter alia that the husband of the petitioner, who is the alleged detenu is accused in Crime No.546/2017 under Sections 376(2)(n), 313, 323, 509 IPC dated 9.10.2017 on the file of Machavaram Police Station and he was arrested on 12.10.2017 and produced before the court of I Additional Chief Metropolitan Magistrate Vijayawada City on 13.10.2017 and the said court remanded him to judicial custody and presently he is lodged in Sub-Jail, Vijayawada. In view of the above averments made in the counter affidavit, no further direction is required to be issued and the writ petition is accordingly closed. No costs. Miscellaneous petitions pending if any, shall stand closed.
