HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 41820 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise, appearing for respondents.

2) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the order of respondent No.4 passed in RC No.167/A/2018, dated 14.11.2018, suspending the petitioner's A4 shop (M/s.Koti Wines) licence vide CT/232/2017-19, as illegal and arbitrary. 3) It is to be noted that the impugned order came to passed pursuant to the explanation given by the petitioner to the show cause notice issued to him, by the Prohibition and Excise Superintendent/respondent No.4, in exercise of the powers conferred under Section 31(1)(b) of the A.P.Excise Act, 1968. 4) When the matter is taken up for hearing, it is submitted by the learned Government Pleader that final orders would be passed within a period of four weeks by concluding the enquiry. 5) Having regard to the nature of the allegations and taking into consideration the submission made by the learned Government Pleader, the Writ Petition is disposed of directing the Prohibition and Excise Superintendent, Chittoor/respondent No.4 herein to complete the enquiry and pass final orders,

within a period of two to three weeks from today. It is also made clear that if no orders are passed within the said period, the petitioner herein is permitted to carry on his business. 6) There shall be no order as to costs.
