THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM I.A.No.1 of 2019 and C.C.C.A.No.222 of 2017 JUDGMENT:

The appeal is filed challenging the judgment and decree dated 31.03.2017 passed in O.S.No.22 of 2004 by the XIV Additional Chief Judge (FTC), City Civil Court, Hyderabad. 2.

I.A.No.1 of 2019 is filed seeking to record compromise in terms of memorandum of compromise dated 28.05.2019 entered into between the parties.

Today, when the matter came up for hearing, the appellants represented by their GPA holders as well as respondent No.1/plaintiff and respondent No.6 are present. Learned counsel for the appellants is not pressing the suit against respondent Nos.3 and 4 and the suit is dismissed as not pressed against them. The name of respondent No.5, who is defendant No.4 in the suit, was deleted vide order dated 12.04.2012 in I.A.No.216 of 2012. Respondent Nos.6 and 7 are legal heirs of respondent No.2, who died during pendency of the suit. Respondent No.6 represented through GPA holder-respondent No.7 and represented by his counsel. 4.

When this Court enquired the parties, they stated that they have decided to settle the dispute between them, pursuant to which, they have entered into a memorandum of compromise on 28.05.2019 and prays to allow the appeal in terms of the memorandum of compromise.

5. In those circumstances, I.A.No.1 of 2019 is ordered and the appeal is allowed in terms of the memorandum of compromise.

6. Office is directed to prepare the decree in terms of the judgment by enclosing the certified copy of the memorandum of compromise dated 28.05.2019.

7. Miscellaneous petitions, if any, pending in this appeal, shall stand closed. No order as to costs.
