This writ petition is filed to declare the proposed action of respondents 1 to 6 in collecting the vacant land tax from respondents 7 to 22, effecting mutation and granting permission for construction over land admeasuring Ac.2-71 cents in Sy.No.442 situated at Hindupur Municipality, Part-II, Ananthapur District, Andhra Pradesh pending adjudication of O.S.No.16 of 2014 before the Additional District Judge, Hindupur as illegal and arbitrary. Heard learned counsel for the petitioner and learned Assistant Government Pleaders for Revenue and Municipal Administration and Urban Development and learned Standing Counsel for the 4th respondent.

Admittedly, the petitioner filed O.S.No.16 of 2014 against unofficial respondents and they have contested the said suit. Having availed the alternative remedy, the petitioner cannot again maintain the present writ petition.

In view of the same, this Court is not inclined to entertain the writ petition and accordingly, the writ petition is disposed of granting liberty to the petitioner to obtain necessary orders in O.S.No.16 of 2014 filed by him. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
