THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21710 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Mines and Geology.

With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

Since this Court is not adjudicating the matter on merits, it may not be necessary to issue notices to the unofficial respondents. The present Writ Petition came to be filed with the following prayer:

'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of respondent Nos.1 to 6 in permitting the quarry operations in Survey No.127 to an extent of 2.50 hectors of Kodakella Village, Veeragattam Mandal, Srikakulam District vide proceedings No.4646/Q/2000, dated 27.05.2008 and Consent Order of respondent No.6 vide order No.11453-VZN/APPCB/ZO-VSP/CFE/2016/2321, dated 11.03.2016, as illegal, arbitrary, without jurisdiction and violation of principles of natural justice and also violation of Articles 14 and 21 of the Constitution of India and also contrary to the procedure contemplated under the provisions of A.P.Minerals and Mines Concession Rules, 1966, consequently quash the same, in the interest of justice and pass such other order or orders as this Hon'ble Court may deem it fit and proper in the circumstances of the case'.

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent to consider the representation dated 26.05.2016 made by the petitioner, in accordance with law.

Without going into merits of the case and having regard to the

circumstances stated above, the Writ Petition is disposed of directing the 2nd respondent to consider the representation dated 26.05.2016 and dispose of the same in accordance with law, as early as possible, preferably within a period of four weeks from the date of receipt of a copy of this order, after hearing the petitioner and the unofficial respondents.
