The case of the petitioner is that he is a landless poor and occupied the subject land to an extent of Ac.3-20 cents in Sy.No.212 of Telukulavanipalem (Babjee Nagar) Hamlet of Vangali Village, Sabbavaram Mandal, Visakhapatnam District and recognizing his possession, the respondents entered his name in revenue records as occupier for the years 1401 to 1414 Fasli. Respondents 4 to 5 along with surveyor came to subject land without any notice and on enquiry by the petitioner, they informed that on instructions from respondents 2 and 3 to prepare layout for the purpose of allotting house sites. It is the grievance of the petitioner that respondents 2 to 5 are interfering with the possession of petitioner over subject land without issuing notice and without following due process of law. Hence, the present writ petition is filed.
Learned Assistant Government Pleader for Revenue basing on instructions submits that the respondents will follow due process of law before taking any action for eviction of petitioner from the subject land, since according to respondents, he is an encroacher. But learned counsel for the petitioner disputes the same and submits that the petitioner has been granted patta and his name is entered in revenue records.
Accordingly, the writ petition is disposed of directing the respondents not to evict the petitioner without following due process of law.
