THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.41866 OF 2018 O R D E R :

In the present writ petition, challenge is to the opening and continuation of the rowdy sheet against the petitioner herein. According to the learned counsel for the petitioner, the action impugned is highly illegal, arbitrary, unreasonable and violative of Article 21 of Constitution of India and A.P.Police Standing Orders, 601. It is further submitted in elaboration that there is no case pending against the petitioner and the only case arising out of SC.No.181 of 2014 against the petitioner also ended in acquittal vide judgment dated 06.04.2017 on the file of I Additional Metropolitan Sessions Judge. It is further submitted that petitioner herein does not fall under any of the provisions of A.P.Police Standing Order 601 as indicated in clause (a) to (i).

Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the writ petition leaving it open to the petitioner herein to file an appropriate application before the 3rd respondent seeking deletion of his name from the list of rowdy sheet, in accordance with law within a period of one week from the date of receipt of copy of this order with a further direction to 3rd respondent to take appropriate action on the said application strictly in accordance with law and A.P.Police Standing Orders, 601 and pass appropriate orders within a

period of four weeks thereafter, from the date of petitioner making an application.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
