Heard learned counsel for the petitioners, learned Government Pleader for Irrigation for respondent No.1 and learned Government Pleader for Revenue for respondent Nos.2 & 3.

This writ petition is filed alleging that even though petitioners succeeded in O.P.No.502 of 1992 on 04.05.1994 and even though E.P.No.08 of 2010 was instituted in the year 2010, so far the amount payable to the petitioners is not deposited in the Court of II Additional District Judge, Karimnagar, causing hardship and suffering to the petitioners.

Having regard to the fact that there was inordinate delay in paying compensation to the petitioners as per the orders passed in O.P.No.502 of 1992, this Court by order dated 23.11.2018, granted time till 21.12.2018 for depositing amount before the concerned Court, and if the amount is not deposited the District Collector as well as Special Deputy Collector, Land Acquisition Officer, Karimnagar, were directed to appear before the Court.

Learned Government pleader produced proceedings of the Special Deputy Collector, Karimnagar, dated 18.12.2018, informing the Government pleader that the compensation amount is already deposited in the concerned Court. 5.

Learned counsel for the petitioners also does not dispute the factum of depositing the amount. However, he disputes the

- 3 - quantum of compensation arrived at by the competent authority and the said quantum is less than what the petitioners are entitled to receive.

Since, E.P.No.08 of 2010 is pending this Court is not inclined to express any opinion on the said claim. Thus, leaving it open to the petitioners to raise the objections as available in law, as to how the amount is arrived at by the competent authority in the pending E.P., the Writ Petition is disposed of.
