HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITON No. 6848 OF 2018 ORDER:

This civil revision petition is filed by the petitioner/J.Drs.1 to 6 and 8, aggrieved by the docket order dated 25.10.2018 passed in EA(SR) No.8229 of 2018 in EP No.41 of 2018 in OS No.347 of 2017 on the file of the court of Additional Senior Civil Judge, Eluru, West Godavari District. The case of the revision petitioners is that they filed a petition under Section 47 r/w Section 151 CPC seeking to set aside the termination order dated 14.08.2018 passed in the said E.P. The Execution Court returned the said petition with an objection as to how the petition is maintainable when the EP itself was terminated.

As can be seen from the return order dated 25.10.2018 passed by the Execution Court, the EP was terminated on 14.08.2018 and thereafter this petition is filed by revision petitioners to set aside the termination order. Since the EP was already terminated, the Execution Court has rightly returned

the petition and the revision petitioners cannot request the court to set aside the termination order by putting the clock back.

Accordingly, the civil revision petition is dismissed at the stage of admission. No costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
