THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.11176 of 2016 ORDER:

Heard Smt. Manjiri S. Ganu, learned counsel for the petitioners, and Sri K. Vivek Reddy, learned Standing Counsel for the Hyderabad Metro Rail Project.

The prayer of the petitioners in this case is as under: "For the reasons disclosed in the accompanying Writ Affidavit, this Honourable Court may be pleased to issue a Writ, Order or Direction in the nature of Mandamus or otherwise declaring the inaction on the part of the Respondents in not properly considering the representation of the Petitioners dated 29-1-2016 and not paying to the Petitioners the amount of Rs.27,86,829/- being compensation in respect of 26.43 sq. yards being portion of their property bearing No. 5-1-912, Putli Bowli, Hyderabad, and keeping the same in a separate account by the Respondents, is bad, illegal, ultra vires, colourable exercise of power and opposed to Arts.14 and 300-A of the Constitution of India and as such declare the same as non-est in law and be pleased to pass such other order or orders as this Honourable Court deems fit and proper in the circumstances of the case."

The petitioners' representation dated 29.01.2016 addressed to the Special Deputy Collector & Land Acquisition Officer, Hyderabad Metro Rail Project, the third respondent, is still pending consideration. As the authority concerned is yet to apply its mind to the grievance of the petitioners and take a decision thereon, this Court sees no reason to entertain this writ petition for adjudication on merits at this stage.

The writ petition is accordingly disposed of directing the third respondent to consider the petitioners' representation dated 29.01.2016 in accordance with law and take appropriate action thereon.

In the event the petitioners' request for payment of

compensation is rejected, the reasons therefor shall be recorded and duly communicated to them. This entire exercise shall be completed expeditiously and in any event, not later than three weeks from the date of receipt of a copy of this order.
