THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.10104 of 2016 ORDER:

This criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in D.V.C.No.7 of 2015 on the file of Additional Junior Civil Judge, Repalle, Guntur District. Heard the learned counsel appearing for the petitioner/respondent No.3 and the learned Additional Public Prosecutor, representing the State.

From a perusal of the complaint it cannot be said that there is no material to proceed against the petitioner/respondent No3. Therefore, it is not a fit case where the proceedings against her can be quashed. The truth or otherwise of the allegations can only be decided during the course of trial.

In the facts and circumstances of the case, the Criminal Petition is disposed of, directing the learned Magistrate to proceed with the enquiry in D.V.C.No.7 of 2015 and dispose of the same within a period of three (03) months from today, however, without insisting for the presence of the petitioner/respondent No.3 during the pendency of the enquiry in the DVC.

Pending miscellaneous applications, if any, shall stand closed in consequence.
