THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 12829 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage. 2.

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent No.2 in not sending the information to the third and fourth respondents to delete the petitioner agricultural land admeasuring Acs.2.20 cents in Survey No.1135/ 2 and Acs.2.69 cents in Survey No.1137/ 1 of Podili Village and Mandal of Prakasam District, under category of assignment land in website which is being maintained by respondent No.3 by considering the recommendation of the Revenue Divisional Officer, Kandukuru dated 19.10.2015 vide R/ B.C.No.2637/ 15, as illegal and arbitrary. 3.

Though various grounds are raised, learned counsel for the petitioner submits that though the RDO sent for recommendations to the Collector deleting the property situated in Survey No.1135/ 2 and Acs.2.69 cents in Survey No.1137/ 1 of Podili Village and Mandal of Prakasam District from the prohibitory list, till date, no action has been initiated. 4.

Learned Government Pleader for Revenue submits that a direction may be given to the Collector for passing appropriate orders basing on the recommendations made by the RDO and Tahsildar. 5.

Having regard to the above, without going into merits of the case, the writ petition is disposed of directing the Collector to consider the recommendations made by the RDO and the Tahsildar with regard to above mentioned lands and pass appropriate orders, in accordance with law, as

early as possible, preferably within a period of two months from the date of receipt of a copy of the order.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No costs.
