THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.20049 of 2016 ORDER:
Heard Sri T.Rajinikanth Reddy, counsel for petitioner and Assistant Government Pleaders for respondents. The petitioner challenges notice dated 06-06-2016 as illegal, arbitrary and without jurisdiction.
The 4th respondent through impugned notice has merely called upon the petitioner to conform to the requirements of G.O.Ms.No.309, dated 01-09-2005.
It is not in dispute that the instant notice is issued pursuant to the directions issued by this Court in PIL No.146 of 2015, dated 24-08-2015.
I have perused the order dated 24-08-2015 in PIL No.146 of 2015 and the notice issued in the writ petition. Prima facie, this court is of the view that no grievance can be made out against the notice impugned in the writ petition. A bare reading of the notice further discloses that the 4th respondent has merely called upon the petitioner to regularize the extraction of ground water as per G.O.Ms.No.309, dated 01-09-2005. May be that the petitioner has permission from other Departments, the direction of this court is comprehensive enough to have permission from the Director, Ground Water Department as well. If the petitioner intends to apply, the petitioner is given liberty to apply within two weeks from the date of receipt of this order and if such application is made, without reference to the time restricted
through the impugned notice, dated 06-06-2016, the 4th respondent is directed to consider and pass appropriate orders. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
