HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 18198 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the respondent company to pay the terminal benefits of the deceased husband of the petitioner forthwith. When the matter is taken up for hearing, it is submitted by the learned standing counsel for the respondent company that the terminal benefits of the deceased husband of the petitioner were withheld, in pursuance of the orders passed by the competent Civil Court in O.S.No.679 of 2001 and O.S.No.1013 of 2002 and, hence, subject to the outcome of the said suits, the terminal benefits, if not already paid to the petitioner, will be paid.

Recording the submission made by the learned standing counsel for the respondent company, the writ petition is disposed of directing the respondent company to pay the terminal benefits of the deceased husband of the petitioner, if not already paid to the petitioner, subject to the outcome of O.S.No.679 of 2001 and O.S.No.1013 of 2002, within a period of eight (8) weeks.
