The present Writ Petition came to be filed questioning the order dated 6.10.2016, passed by the 2nd respondent in D.Dis. No.2851/R4-2/2016 as illegal and arbitrary.
A perusal of the impugned order shows that the transfer of mining lease application dated 4.3.2015 submitted by the petitioner was received after the notification dated 10.2.2015 issued by the Government of India and hence the second application of transfer of mining lease submitted by the petitioner is ineligible and the same was also rejected on the ground that the same should be in Form-R prescribed.
Learned Government Pleader for Mines would submit that the petitioner may be directed to submit a fresh application in the prescribed form, in which event, the respondent-authorities shall consider the same, in accordance with law.
Having regard to the above, the writ petition is disposed of directing the petitioner to submit a fresh application in the prescribed form, in which event, the respondent-authorities shall consider the same, in accordance with law, as early as possible, preferably within a period of two months from the date of submission of the same. No order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
