- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.41940 OF 2018 ORDER :

Heard learned counsel for the petitioners, learned Government Pleader for Land Acquisition for respondent No.1 and learned Standing counsel for respondent No. 2. 2.

Petitioners claim to be the owners of independent house plots in Golden Paradise-II layout in Sy.Nos.110 and 111 of Savaravilli Village, Bogapuram Mandal, Vizianagaram District. This writ petition is filed alleging that the respondents published notice dated 07.02.2018 under the National Highways Act, 1956 (for short 'the Act') without mentioning the persons interest and the same is illegal.

When the matter is taken up, learned Standing counsel representing the National Highways Authority, placed before this Court a copy of the Award dated 16.11.2018 and informs the Court that in the Award the compensation payable to each of the plot owners is independently discussed.

At this stage, learned counsel for the petitioners seeks leave of the Court to file appropriate application for enhancement of compensation.

As per Section 3 (G) (5) of the Act, an aggrieved person who is not satisfied with the compensation determined can file an application for determination of higher compensation by the Arbitrator.

Thus, granting liberty to the petitioners to file appropriate application for reference to the Arbitrator to determine higher claim for compensation, the Writ Petition is disposed of. Pending miscellaneous petitions shall stand closed. __________________ P.NAVEEN RAO,J 4th December, 2018 Rds
