THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8669 of 2016 ORDER:
This petition under Section 482 Cr.P.C., is filed by the petitioners/A.1 to A.3 to direct the Station House Officer, Keesara Police Station, Cyberabad, to release the cash of Rs.3,62,790/- and 3 cell phones (I-S Phones) said to have been seized along with the contraband namely 458.40 quintals of suspected PDS rice under the provisions of the Essential Commodities Act (for short 'the Act'). Along with the stock, the police have also seized two lorries. The contention of the petitioners is that so far vehicles and rice are concerned, it is the Joint Collector to pass appropriate orders under the provisions of the Act. But in sofar as cash and cell phones that are seized by the police, crime is registered and the property is deposited in the Court, it is for the learned Magistrate to give interim custody thereof.
Accepting the said contention, the learned Magistrate is directed to release cash of Rs.3,62,790/- and three cell phones to the petitioners/A.1 to A.3 subject to the condition that the petitioners should furnish personal bond for Rs.4,00,000/- together and produce the said property now taken interim custody, before the Court as and when directed.
With the above directions, the Criminal Petition is disposed of.
5. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
