This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.1, for grant of bail in Crime No.75 of 2018 of Prohibition & Excise Police Station, Srikalahasti, Chittoor District, registered for the offence punishable under Sections 8(c) read with 20(b)(ii)(c) of NDPS Act, 1985. 2.

Heard the learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

The earlier bail petition of the petitioner was dismissed by this Court vide order dated 01.11.2018 in Crl.P.No.11161 of 2018 stating that the petitioner/A.1 was found in possession of 24 kilograms, which is of commercial quantity. There are no changed circumstances. The petitioner/A.1 is not entitled for bail under Section 439 Cr.P.C. The petition is devoid of merit and is liable to be dismissed.
