THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.41932 OF 2018 ORDER: (per SK,J) The petitioner is the unsuccessful applicant in O.A.No.2967 of 2017 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. His prayer in the said O.A. was to direct the authorities concerned to dispose of his representation dated 30.06.2017 wherein he sought various benefits. By order dated 31.10.2017, the Tribunal held that it was for the authorities to take a decision on the pending representation and dismissed the O.A. holding that it was not maintainable at that stage. Be it noted that the petitioner's representation was made on 30.06.2017 and it had not been considered despite the lapse of four months as on the date of dismissal of the O.A.

It is not open to the authorities to sleep over such representations as it would have an adverse impact on the morale of employees who seek redressal of their grievances by making such representations. The Tribunal therefore ought to have been mindful of this aspect and ought not to have dismissed the O.A. without issuing any direction to the authorities concerned in the context of the pending representation.

The writ petition is accordingly disposed of at the admission stage, with the consent of the learned Government Pleader for Services, State of Andhra Pradesh, directing the Superintendent, SVRR Government General Hospital, Tirupathi, Chittoor District, the first respondent, to consider the petitioner's representation dated 30.06.2017 on its own merits and take appropriate action thereon in accordance with law. Needless to state, in the event any of the grievances put forth by the petitioner in the said

representation require the attention of any higher authorities, it would be open to the first respondent to forward the representation of the petitioner to such authority in so far as that grievance is concerned. This exercise shall be completed expeditiously and, in any event, not later than four weeks from the date of receipt of a copy of this order.
