O R D E R

Aggrieved by the action of the respondents 5 and 6 - Registration Authorities, in not receiving and registering the document presented by the petitioner in respect of the subject property bearing Door No.22-1-29, RR road, Revenue Ward No.4, Kakinda in block No.5, Ward No.3, T.S.No.501/ 1 part, totally admeasuring 320 sq. yards of East Godavari Sub Registration District of Kakinada, the present writ petition is filed. Learned counsel for the petitioner and the learned Assistant Government Pleader for Registration and Stamps, submitted that the lis in the present writ petition is squarely covered by the order passed by this court in W.P.No.27 of 2014 dated 13.06.2014 and hence the same may be disposed of in terms of the said order.

Having regard to the facts and circumstances of the case, and for the reasons alike, the present writ petition is allowed in terms of the order dated 13.06.2014 in W.P.No.27 of 2014, and the competent authority / respondents 5 and 6 are directed to receive and process the deed of conveyance in respect of the subject property, in accordance with the Indian Registration Act, 1908 and Indian Stamp Act, 1899 and register and release the same to the petitioner if the document is otherwise in order. However, this order does not preclude the Government to establish by due process of law that the property in Sy.No.501/ 1(part) is also prohibited property or that the subject land is part of Sy.No.501/ 1A. Copy of the order dated 13.06.2014 in W.P.No.27 of 2014 be annexed to this order.

Interlocutory applications pending, if any, shall stand closed. No costs.
