Heard learned counsel for the petitioner, learned Government Pleader for Panchayat Raj for respondents 1 to 3 and Sri K.K. Durga Prasad, learned Standing Counsel for respondent No.4.

Petitioner claims to be resident of Vendra Village, Pedapudi Mandal, East Godavari District. This Writ Petition is filed alleging that some persons are undertaking construction of Arch at the entrance of the bridge constructed over irrigation canal and if such construction is made, it would be causing hindrance to free flow of goods vehicles carrying on the agricultural produce and would cause lot of hardship to the farmers in and around the irrigation canal.

Having regard to the contention of the petitioner that construction of Arch would cause hindrance to the traffic, by order dated 26.11.2018, this Court directed the District Panchayat Officer to inspect the construction site and submit report as to whether there are goods transport vehicles which pass through the bridge for transportation of agricultural produce and whether the present height earmarked for construction of Arch would obstruct the free flow of goods transport vehicles. 4.

The District Panchayat Officer filed his report, signed on 07.12.2018, along with the photograph and the same is taken on record. According to the said report, the height of the Arch is

16 feet and there will be no obstruction for free flow of the goods transport vehicles and it will not result in creating problems for the farmers to sell their agricultural produce.

In view of the same, the apprehension expressed by the petitioner is no more valid and the Writ Petition is accordingly disposed of. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ P. NAVEEN RAO, J Date:10.12.2018 KH
