The case of the petitioner is that she is the absolute owner of Plot Nos 103 and 104, admeasuring 622.0 square yards in Sy.Nos 55 and 56, under Block No.9, situated at Raghavendra Nagar, Jillelaguda Village, Saroornagar Mandal, Ranga Reddy District having purchased the same under a registered sale deed No.14087/2003, dated 20-11-2003. Since the date of purchase, the petitioner is in possession and enjoyment of subject plots. The Government of Andhra Pradesh has issued G.O.Ms.No.747 Revenue (UC-I) Department, dated 02-08-2008 for regularization of unauthorized layouts. In pursuance of the said G.O. the petitioner made an application to the 3rd respondent for regularization of her plots vide application No.8041, dated 27-09-2008 and paid requisite fee. That the 3rd respondent vide Lr.No.
00861/6/LPS/HMDA/Plg/2012, dated 03-03-2012 rejected the application of the petitioner saying that survey numbers are covered by ULC surplus lands and required ULC clearance certificate. On 28-11-2012, the petitioner has submitted an application to the 2nd respondent requesting for issuance of ULC clearance in respect of subject plots and also paid necessary fee of Rs.3,15,000/- towards issuance of ULC clearance. Again on 28-12-2012, the petitioner submitted an application to the 4th respondent for regularization of her plots.
her plots. The 3rd respondent rejected her application stating that the land in Sy.Nos 55 and 56 of Jillelaguda Village are ceiling surplus lands and NOC not uploaded by the 5th respondent. Since her application for regularization of plots under G.O.Ms.No.747 is not being disposed of, the petitioner filed the present writ petition.
Learned Assistant Government Pleader for Revenue produced written instructions stating that the Government vide G.O.Ms.No.947, dated 02-08-2008 allotted the surplus land in Sy.Nos 33, 34, 35, 36, 55 and 56 of Jillelaguda Village, Saroornagar Mandal to an extent of 18,000 square meters to A.P.Housing Board (APHB) for utilization of land in the public interest and surplus land was handed over to APHB after conducting panchanama on 04-08-2008. Due to nonidentification of the land to an extent of 18,000 square meters allotted to APHB in Sy.Nos. 33, 34, 35, 36, 55 and 56 of Jillelaguda Village, Saroornagar Mandal, the said applications were not processed.
As they are third party applicants who are in physical possession and eligible for regularization and some of them are residing in their plots by constructing houses, the 5th respondent addressed a letter to the Government for withdrawal/cancel the GO.Ms.No.947, dated 02-08-2008 to enable them to process the pending applications for regularization in terms of G.O.Ms.No.747, dated 18-06-2008.
