HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.4 1 9 3 7 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Divisional Police Officer, West Sub-Division, Guntur Urban District, dated 29.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that basing on the complaint of the petitioner's wife Dr.Yerram Rajya Lakshmi, a case was registered in Cr.No.79/ 2015 dated 12.03.2015 for the offences under Sections 302, 380, 120(B) r/ w 34 I.P.C., against i) Shaik Jani Baji and ii) Dr.Kurri Siva Nagi Reddy petitioner herein on the file of Pattabhipuram Police Station. The investigation revealed that A.1 murdered the deceased Yerram Subbayamma who is the mother of the de facto complainant as per the conspiracy with A.

2 petitioner herein and also A.1 committed theft of cash. The charge sheet filed on 29.08.2015 vide S.C.No.446/ 2015 and the case is pending trial before the Hon'ble Additional District Judge Court, Guntur. It is further submitted that basing on the involvement of the petitioner in the above criminal case, the Sub-Divisional Police Officer, West Division, accorded permission to open the history sheet against the petitioner vide C.No.113/ SDPOWD/ 2017, dated 01.11.2017, on the file of Pattabhipuram Police Station, vide rowdy sheet No.139-A, and the same is continued upto date. It is submitted that the petitioner contended that the respondents harassed and threatened him by calling through phone is incorrect and baseless.

In this contention, it is submitted that to maintain and review the rowdy sheet against the petitioner, the respondents called the petitioner on various dates to attend the Police Station along with Aadhar Card, photos and finger prints. It is submitted that the respondents did not harass or threaten the petitioner as alleged by him.

It is submitted that the petitioner contended that the respondents Police threatened the petitioner that the police are opening the rowdy sheet against him in incorrect and baseless. It is submitted that already rowdy sheet has been opened as per the proceedings of the Sub-Divisional Police Officer, West Division, vide C.No.113/ SDPO-WD/ 2017, dated 01.11.2017 on the file of Pattabhipuram Police Station, vide rowdy sheet No.139-a, and the same is continued up to date."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Divisional Police Officer, West Sub-Division, Guntur Urban District, dated 29.11.2018. However, it is open for the petitioner herein to assail the history sheet opened against him.
