THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 12712 of 2016 ORDER:

Heard Sri K.Venumadhav, learned counsel for the petitioner, and Sri N.Praveen Kumar, learned Standing Counsel for the Jagtial Municipality.

The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue an order or direction more particularly one in the nature of writ of Mandamus or any other appropriate writ declaring that the action of respondents no.1 to 5 in not issuing appropriate proceedings considering the request of the petitioner for allotment of the LIGH Quarter No.7-5-211, situated at Vidyanagar, Jagtial Proper and Mandal of Karimnagar District on hire purchase basis considering the applications submitted by him dated 07-10-2002, 18-06-2003 and 29-06and the correspondence taken between the respondents no.

1 to 5 through letters addressed dasted 1812-2002, 27-05-2003, 29-05-2009, 21-10-2010, 02-02-2011, 05-10-2013 and 02-08-2013 between them, as considered other similarly situated candidates, is nothing but arbnitrary, illegal, null and void and violative of principles of natural justice and also violative of Articles 14, 19 and 21 of the Constitution of India. Consequently direct the respondents no.1 to 5 to consider the request of the petitioner for the allotment of the LIGH Quarter No.7-5-211, situated at Vidyanagar, Jagtial Proper and Mandal of Karimnagar District, on hire purchase basis considering the applications submitted by him dated 07-10-2002, 186-2003, 29-06-2013 and the correspondence taken between the respondents no.

1 to 5 through letters addressed dated 18-12-2002, 27-05-2003, 29-05-2009, 21-10-2010, 02-022011, 05-10-2013 and 02-08-2013 between them, and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."

As the petitioner is stated to have made several representations, the last of them being on 29.06.2013, and the Municipal authorities are yet to consider the same and take appropriate action thereon, this Court sees no purpose in entertaining this writ petition for adjudication on merits. It is for the authorities concerned to consider the request made by the petitioner in accordance with the relevant norms and take a decision.

The writ petition is therefore disposed of directing the municipal authorities concerned to consider the petitioner's representations, the last of which is dated 29.06.2013, in accordance with law and take appropriate action in the matter. In the event the petitioner's request for allotment of the LIGH Quarter is rejected, the reasons therefor shall be recorded and duly communicated to him. This entire exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ________________________________ JUSTICE SANJAY KUMAR April 19, 2016 Lmv
